SI 2020/1309 – The Immigration and Social Security Co-ordination (EU Withdrawal) Act 2020 (Consequential, Saving, Transitional and Transitory Provisions) (EU Exit) Regulations 2020

SI 2020/1309 amends legislation in the field of immigration (including access to benefits and services) and nationality from a day to be appointed.

The Immigration and Social Security Co-ordination (EU Withdrawal) Act 2020 (Consequential, Saving, Transitional and Transitory Provisions) (EU Exit) Regulations 2020 are made in exercise of the powers conferred by the Immigration and Social Security Co-ordination (EU Withdrawal) Act 2020, s. 5(1), in order to make provision in consequence of or in connection with Pt. 1 of that Act which (amongst other things), makes provision to end rights to free movement under EU retained law. These regulations make amendments to legislation in the fields of immigration (including access to benefits and services), and nationality, including consequential amendments to:

The Tax Credits (Residence) Regulations 2003 (SI 2003/654);

The Tribunal Procedure (Upper Tribunal) Rules 2008 (SI 2008/2698); and

The Appeals (Excluded Decisions) Order 2009 (SI 2009/275).

The regulations come into force at the same time and date as ISSCA 2020, Sch. 1, para. 2(2) comes into force except certain provisions which come into force on 1 December 2020 and 1 July 2021.
