SI 2020/74 - The European Union (Withdrawal) Act 2018 (Commencement No. 5, Transitional Provisions and Amendment) Regulations 2020

SI 2020/74 commences specified provisions in EUWA 2018 and amends SI 2018/808 from ‘exit day’ (31 January 2020).

The European Union (Withdrawal) Act 2018 (Commencement No. 5, Transitional Provisions and Amendment) Regulations 2020 bring into force provisions of the European Union (Withdrawal) Act 2018 (EUWA 2018) on “exit day” (meaning 31 January 2020 at 11 p.m. in accordance with EUWA 2018, s. 20(1)), including:

s. 7(1) and (6), which relates to the status of retained EU law; and

Sch. 8, para. 7, 8 and 10 to 12, which provide glosses to existing and future powers to make subordinate legislation respectively.

The regulations also amend the European Union (Withdrawal) Act 2018 (Commencement and Transitional Provisions) Regulations 2018 (SI 2018/808), deferring the day appointed for the coming into force of provisions relating to the repeal of the European Union Act 2011 (to the extent not already been commenced) from ‘exit day’ to ‘IP completion day’ (31 December 2020 at 11 p.m.), as well as amending the transitional provision in SI 2018/808. The regulations were made on 29 January 2020.
