2019/419 - The Data Protection, Privacy and Electronic Communications (Amendments etc) (EU Exit) Regulations 2019

SI 2019/419 amends data protection legislation in connection with the UK withdrawal from the EU.
The Data Protection, Privacy and Electronic Communications (Amendments etc) (EU Exit) Regulations 2019 make amendments to legislation in relation to the regulation of the processing of personal data, including changes which have the effect of merging two pre-existing regimes for the regulation of the processing of personal data – namely that established by the GDPR as supplemented by the Data Protection Act 2018, Pt. 2, Ch. 2 as originally enacted, and that established in the DPA 2018, Pt. 2, Ch. 3 as originally enacted (the applied GDPR). The applied GDPR extended GDPR standards to certain processing out of scope of EU law and the GDPR. The regulations further make amendments consequential to the DPA 2018 and related amendments which appear in DPA 2018, Sch. 19 but have not been commenced are repealed. The regulations come into force in part on 29 March 2019 and otherwise on Exit day (defined by EUWA 2018, s. 20(1) as 29 March 2019 at 11.00 p.m.).
